FBR imposed 5% tax on map approval

ایسا لگتا ہے کہ پراپرٹی سیکٹر پر ٹیکس لگانے کا عمل ابھی ختم نہیں ہوا ہے۔ فیڈرل بورڈ آف ریونیو (ایف بی آر) نے تجارتی اور رہائشی منصوبوں کے نقشے کی منظوری پر 5 فیصد ٹیکس عائد کیا ہے۔ ابتدائی طور پر یہ ٹیکس ان ہاؤسنگ سوسائٹیز پر لاگو ہوگا جو لاہور ڈویلپمنٹ اتھارٹی (ایل ڈی اے) کے دائرہ اختیار میں آتی ہیں۔

اس سے قبل جولائی میں محکمہ ایکسائز اینڈ ٹیکسیشن نے اعلان کیا تھا کہ دو یا زیادہ سالوں سے خالی پڑے پلاٹوں کے مالکان کو جائیداد کی قیمت کا 10 فیصد ٹیکس دینا ہوگا۔ چونکہ خالی پلاٹوں پر یہ ٹیکس صوبائی حکومت جمع کرے گی ، اس کا حساب ڈپٹی کلکٹر کے ریٹ کے حساب سے کیا جائے گا۔ لہذا آپ کسی پلاٹ کو 10 فیصد ٹیکس ادا کیے بغیر خالی نہیں رکھ سکتے اور 5 فیصد ایف بی آر ٹیکس کی وجہ سے اس پر کوئی بھی تعمیر اب زیادہ مہنگی ہے ، جس کا حساب فی ایف بی آر ویلیویشن ٹیبل کے مطابق کیا جائے گا۔

لے آؤٹ پلان کی منظوری

لے آؤٹ پلان کی منظوری پر ٹیکس کا اعلان 23 ستمبر 2016 کو کیا گیا تھا اور ایف بی آر نے اس ٹیکس کو نافذ کرنے کے لیے ایل ڈی اے کو تحریری طور پر بھی مطلع کیا ہے۔ ایل ڈی اے آفس میں اپنے گھر یا پلازہ کا لے آؤٹ پلان منظوری کے لیے جمع کرانے کے خواہشمند افراد کو پہلے ایف بی آر کو 5 فیصد ٹیکس ادا کرنا ہوگا۔ ایف بی آر کی رسید کے بغیر ، ایل ڈی اے کسی بھی درخواست پر غور نہیں کرے گا۔ ایل ڈی اے نے متعلقہ ڈائریکٹوریٹس کو ایف بی آر کی نئی ٹیکس پالیسی کو نافذ کرنے کی بھی ہدایت کی ہے۔

فی مرلہ کے حساب سے ایف بی آر کا آؤٹ پلان

تین مرلہ رہائشی یونٹ کے لے آؤٹ پلان کے لیے ایف بی آر 20 روپے فی مربع فٹ وصول کرے گا۔ 6 مرلہ یونٹس کے لیے یہ شرح 40 روپے ہے جبکہ 6 مرلہ سے بڑے رہائشی یونٹس کے لے آؤٹ منصوبوں کے لیے یہ شرح 70 روپے ہے۔ تجارتی عمارتوں کے لیے ایف بی آر نے 210 روپے کا فلیٹ ٹیکس نافذ کیا ہے۔ یہاں کہ ایف بی آر پہلے ہی رئیل اسٹیٹ ڈویلپرز پر 5 فیصد ایڈوانس ٹیکس لگا چکا ہے ، اور ڈویلپر اس ٹیکس کی ادائیگی کے بعد ہی متعلقہ ہاؤسنگ سوسائٹی کے لیے این او سی کے لیے درخواست دے سکتا ہے۔

رئیل اسٹیٹ سیکٹر پر ٹیکس لگانا درست ہے یا غلط اس پر بحث کیے بغیر ، مجھے یہ کہنا چاہیے کہ اسٹیک ہولڈرز کے لیے صورتحال تھوڑی پریشان کن ہو رہی ہے۔ ان ٹیکسوں کی اپنی خوبیاں اور خامیاں ضرور ہیں لیکن ایک بات یقینی ہے۔ تبدیلیاں بہت تیزی سے ہو رہی ہیں اور یہ سب کچھ سنبھالنا بہت زیادہمشکل ہے۔

 

FBR imposed 5% tax on map approval

It appears that the method of imposing taxes on the property sector isn’t over yet. The Federal Board of Revenue (FBR) has imposed a 5% tax on the approval of maps for commercial and residential projects. Initially, the tax is going to be applicable to the housing societies that fall within the jurisdiction of the Lahore Development Authority (LDA).

Earlier in July, the Excise and Taxation Department announced that owners of plots that are vacant for 2 or more years would be required to pay a tax of 10% of the property value. Since this tax on empty plots would be collected by the provincial government, it’ll be calculated per the Deputy Collector’s rate. So you can’t keep a plot vacant without paying the 10th tax on it and any construction on it is now more expensive due to the five hundred FBR tax, which might be calculated per the FBR valuation tables.

Approval of layout plan

The tax on layout plan approval was announced on September 23, 2016, and also the FBR has also intimated LDA in writing to implement this tax. the folks looking to submit a layout plan of their house or plaza in the LDA office for approval would first pay 5% tax to the FBR. Without the FBR receipt, LDA won’t entertain any application. LDA has also directed the directorates concerned to implement FBR’s new tax policy.

FBR out plan per marla

For the layout plan of a 3-marla residential unit, FBR will charge PKR 20 per square foot. For 6-marla units, the rate is PKR 40 while for layout plans of residential units bigger than 6-marla, the rate is PKR 70. For commercial buildings, FBR has implemented a flat tax of PKR 210. Furthermore, it should be noted here that FBR has already imposed a 5% advance tax on assets developers, and also the developer can only apply for NOC for the respective housing society after they pay this tax.

Without debating whether applying taxes on the real estate sector is correct or wrong, i need to say that truth is getting a touch disturbing for the stakeholders. These taxes certainly have their merits and demerits but one thing is certain; the changes are happening too quickly and it’s all a small amount an excessive amount to handle.
