پاکستان میں جائیداد کے وارث کی وفات کے بعد وراثت میں جائیداد کی تقسیم کے لیے شرعی اصول کی پیروی کی جانی چاہیے۔ جیسا کہ اسلام نے خواتین کو جائیداد میں ان کا جائز حصہ دیا ہے۔ مسلم فیملی لاز آرڈیننس ، 1961 اور مسلم پرسنل لاء شریعت ایپلیکیشن ایکٹ ، 1962 ان حقوق کی حفاظت کرتا ہے۔ وہ اس بات کو بھی یقینی بناتے ہیں کہ پاکستان میں وراثت میں ملنے والی جائیداد کی تقسیم میں خواتین کو ان کا مناسب حصہ ملے۔

درحقیقت پاکستان پینل کوڈ کا سیکشن 498-A خاص طور پر وراثت میں ملنے والی جائیداد کی غیر منصفانہ تقسیم کے خلاف انتباہ کرتا ہے۔ اس میں عورتوں کو ان کا جائز حصہ اپنے مرد رشتہ داروں کے حوالے کرنے پر مجبور کرنے کے نتائج کے بارے میں بھی بات کی گئی ہے۔ متن میں کہا گیا ہے ، ‘جو کوئی بھی دھوکہ دہی یا غیر قانونی طریقے سے کسی خاتون کو جانشینی کے آغاز کے وقت کسی بھی منقولہ یا غیر منقولہ جائیداد کے وارث ہونے سے محروم کرتا ہے اسے دس سال تک کی توسیع کی قید کی سزا دی جائے گی ۔ پانچ سال یا دس لاکھ روپے جرمانہ یا دونوں کے ساتھ بھی سزا عائد ہو سکتی ہے

پاکستان میں وراثت میں ملنے والی جائیداد کی تقسیم قانونی وارثوں کی تعداد اور ان کی جنس پر منحصر ہے۔ کچھ دوسری شرائط بھی ہیں جو ہر وارث کے حصص کو متاثر کر سکتی ہیں۔ لیکن یہ عام فارمولا ہے جو جائیداد کی تقسیم کے لیے استعمال ہوتا ہے۔ یہ بتانا بھی ضروری ہے کہ میت کے منقولہ اور غیر منقولہ اثاثوں کی کل رقم کا تعین اس کے قرض ، رہن اور دیگر ذمہ داریوں کے قانونی طور پر طے ہونے کے بعد کیا جاتا ہے۔

بیٹی کے وراثت کے حقوق

اگر کسی عورت کے ایک یا ایک سے زیادہ بھائی ہوں تو وہ اپنے والد کی موت کے بعد بھائی سے حصہ وصول کرے گی۔ اس کا مطلب ہے کہ قانون کے تحت ایک مرد دو حصوں کا وارث ہوگا جبکہ خاتون وارث ایک حصہ کا وارث ہوگی۔اگر کسی عورت کی ایک یا ایک سے زیادہ بہنیں ہیں لیکن کوئی بھائی نہیں ہے ، تو جائیداد کا 2/3 حصہ (قرض اور دیگر بیلنس ادا کرنے کے بعد) تمام بہنوں میں یکساں طور پر تقسیم کیا جائے گا۔دریں اثنا ، اگر کوئی عورت اپنے والدین کی اکلوتی اولاد ہے تو اسے ½ جائیداد ملے گی۔

ماں کے وراثتی حقوق

نمبر1:اپنے بیٹے کی موت کے بعد ، ایک عورت کو جائیداد کا 1/6 واں حصہ ملے گا۔ باقی کو اس کے شوہر اور میت کے بچوں کے درمیان تقسیم کیا جائے گا۔

نمبر2:اگر میت کے کوئی بچے یا بھائی نہ ہوں اور صرف والدین قانونی وارث ہوں تو عورت جائیداد کا 1/3 حصہ وصول کرے گی۔ باقی دو حصص اس کے شوہر کو جائیں گے۔

نمبر3:اگر میت کے بھائی ہوں تو ایک عورت کو جائیداد کا 1/6 واں حصہ ملے گا۔

بیوی کے وراثتی حقوق

نمب1:اگر میت کے بچے ہیں تو ، ایک عورت اپنے شوہر کی موت کے بعد جائیداد کا 1/8 واں حصہ وصول کرے گی۔

نمبر2:تاہم ، اگر میت کی کوئی اولاد نہیں تھی ، تو وہ جائیداد کے 1/4 حصے کی صحیح مالک ہوگی۔

اپ ڈیٹ (19 جنوری ، 2021): ایک معروف اخبار میں شائع ہونے والی رپورٹ کے مطابق سینیٹ کی قائمہ کمیٹی برائے قانون و انصاف نے متفقہ طور پر خواتین کے املاک کے حقوق کا نفاذ ، 2020 منظور کیا ہے ، جس کا مقصد پاکستان میں خواتین کے املاک کے حقوق کی حفاظت اور حفاظت کرنا ہے۔

ویمن پراپرٹی رائٹس بل 2020 کے سیکشن 7 اے میں کہا گیا ہے کہ ‘مقدمے کا طریقہ کار پہلے سے زیر التوا ہے: کسی بھی قانون میں موجود کسی بھی چیز کے باوجود اس وقت نافذ ہے ، جہاں عورت کی وراثت میں جائیداد کی تقسیم کے ذریعے قبضے کا مقدمہ کسی بھی عدالت میں پہلے سے زیر التوا ہے اس کا فیصلہ سرکاری گزٹ میں اس ایکٹ کی اشاعت سے 60 دن کے اندر کیا جائے گا۔اس میں مزید کہا گیا ہے کہ ، ‘مقدمات کی سماعت کے لیے ججوں کا سیکشن 7B نوٹیفکیشن: ڈسٹرکٹ جج سول جج کو نامزد کرے گا کہ وہ اس ایکٹ کے تحت زیر قبضہ تقسیم اور ملکیت کے مقدمات کو خصوصی طور پر آزمائیں۔’

There has always been a substantial amount of confusion revolving around the property rights of women in Pakistan, especially when it involves real estate ownership and division of inherited property.

However, attributable to certain social and cultural restrictions together with a general lack of awareness regarding the problem, most women within the Pakistani society don’t know their own property rights or a way to effectively exercise them. this is often one of the main reasons why women across the country, particularly within the rural areas, often end up giving away their share to male relatives, completely unaware of their fundamental rights under the constitution of Pakistan.

Some of the laws governing and protecting the legal property rights of women in Pakistan are as follows:

Women’s Right of Inheritance in Pakistan
Pakistan follows the Sharia rule for the division of inherited property among heirs following the death of the owner. As Islam has given women their rightful share within the property; the Muslim Family Laws Ordinance, 1961, and also the Muslim Personal Law Shariat Application Act, 1962 protect those rights. They also ensure women get their justifiable share within the division of inherited property in Pakistan.

In fact, Section 498A of Pakistan’s legal code specifically warns against an unfair division of inherited property. It also talks about the implications of forcing women to surrender their rightful share to their male relatives. The division of inherited property in Pakistan depends on the number of legal heirs and their gender. There are other conditions that will affect the shares of every heir. But this is often the overall formula used for the distribution of property. it’s also important to say that the entire amount of movable and immovable assets of the deceased are determined once his or her loans, mortgages, and other liabilities have all been legally settled.
Inheritance Rights of a Daughter

In case a woman has one or more brothers, she’ll receive ½ of the brother’s share following her father’s death. It means a male heir will inherit two shares under the law while the female heir will inherit one.

If a woman has one or more sisters but no brothers, then 2/3rd of the property (after paying off loans and other balances) is equally divided among all sisters. Meanwhile, if a woman is that the only child of her parents, she’s going to receive ½ of the property.

Inheritance Rights of a Mother

  • Following her son’s death, a woman will receive 1/6th of the property. the remainder is divided between her husband and the deceased’s children.
  • If the deceased had no children or brothers and only parents because of the legal heir, a woman will receive 1/3rd of the property. the opposite two shares will visit her husband.
  • In case the deceased had brothers, a woman will receive 1/6th share of the property.

Inheritance Rights of a Wife

  • If the deceased has children, a woman will receive 1/8th of the property following her husband’s death.
  • However, if the deceased failed to have any children, she’s going to be the rightful owner of 1/4th of the property.

Of course, there are certain special circumstances that will affect the division of inherited property in Pakistan. Moreover, the property rights of women and also the shares they receive vary with different religions and sects.

Other Property Structures and Rights for women

Contrary to popular belief, women in Pakistan have the right to have property. Here are some property-related legal rights of women in Pakistan that you simply should realize.

1). Dower and Dowry
Dower, also called Mehr, could be a gift a husband is guaranteed to pay his wife. the shape of Mehr and its quantity is mostly decided by the families of the bride and groom.

Whether the husband gives his wife a house or money that she uses to get a house, the woman becomes the only owner of the property. Once its title ownership is transferred to her name, the wife can do as she pleases therewith property under the Property Transfer Act, 1882, and also the Muslim Family Laws Ordinance, 1961. In fact, she is legally allowed to sell it without even sharing it together with her husband.

However, just in case a wedding doesn’t survive, the Dissolution of Muslim Marriages Act, 1939, ensures that women have complete ownership of all property that they had earned for themselves. But it’s important to say if the woman demands dissolution of marriage, also referred to as khula, she cannot claim her right to the Mehr. Similarly, if it had been the husband’s decision, the woman is entitled to her dower.

Furthermore, a woman has full rights to her dowry. it’s a movable or immovable property given by the bride’s family as a social practice. If the oldsters or guardians of a woman provide a house or the other style of assets as a dowry, the woman becomes its sole owner. However, she must have the property transferred to her name. If a woman’s name is present on the ownership deed, nobody can deprive her of her property rights in Pakistan.

2). Gift Deed and Will
Another general misconception is that women cannot execute a Will or testament in their lives. Under the law, a woman doesn’t inform her legal heirs or obtain their consent to dispose of 1/3rd of her legally owned property in Pakistan. However, if the need favors one among the legal heirs or exceeds 1/3rd of the estate, the consent of other legal heirs is required.

In a similar manner, a woman can give away some or all of her property through Hiba (gift) in her lifetime. she will be able to also execute a present Deed with instructions about how her property must be handled following her death. If a woman acquires property via a Gift Deed, she becomes the only owner of it.

Important Note:
As per the report published in a leading newspaper, the Senate Committee on Law and Justice has unanimously passed the Enforcement of Women’s Property Rights Bill, 2020, which aims to shield and secure the property rights of women in Pakistan.

Though the constitution allows equal property ownership rights to women, an oversized number of women across the country are forced to giving up their share in inheritance in favor of male relations. However, the most recent amendment seeks a fast and efficient mechanism to make sure women are ready to receive their justifiable share within the property.

The Section 7A of the Enforcement of Women’s Property Rights Bill, 2020, states, “procedure for suit already pending: notwithstanding anything contained in the other law for the time being operative, where the suit for possession through the partition of the inherited property of a woman is already pending in any court of law the identical shall be decided within 60 days form the publication of this act within the official gazette.”

It further adds, “Section 7B notification of judges to undertake suits: the district judge shall designate the civil judge to exclusively try the cases of possession partition and ownership mentioned under this act.”
